High Court orders immediate release of Orji Kalu from prison

A Federal High Court sitting in Lagos on Tuesday ordered the immediate release of former Abia governor, Senator Orji Uzor Kalu from prison.

This is following a Supreme Court ruling on May 8, 2020, which nullified the conviction of the senator by Justice Mohammed Idris in 2019.

Justice Idris had sentenced Kalu and one other to twelve years imprisonment over an allegation of fraud on charges brought against him by the Economic And Financial Crimes Commission, while he was governor of Abia State.

The Supreme Court however, voided the judgment, saying that since Idris had been elevated to the Court of Appeal, he ought not to have delivered judgement in the case.

Based on this, Justice Muhammed Liman, of the Federal High Court quashed the charges and ordered the immediate release of the former governor.

According Justice Liman, this became necessary since the Supreme Court held that Justice Idris gave the judgment without jurisdiction.
